Customer data will only be used to provide services to customers, including purposes consistent with providing those services. The company will not use customer data or derive data from customer data for any advertising or similar commercial purposes. Customers will retain all rights, title, and interest in and to their customer data. The company acquires no rights in customer data except the rights customers grant to the company to provide the services to customers.
The company will not disclose customer data outside the company except
(1) as instructed by the customer
(2) with the customer's permission
(3) as required by law. If the company receives any other request for customer data from outside parties, it will promptly notify the customer.
The company is committed to helping protect the security of customer data. The company has implemented and will maintain and follow appropriate technical and organizational measures designed to protect customer data against accidental, unauthorized or unlawful access, disclosure, alteration, loss or destruction.
The Company grants the Service User a personal, non-exclusive, non-transferable, royalty-free license to use the software provided by the Company as part of the services, for use anywhere in the world. This license is solely for enabling the Service User to use and benefit from the services provided in accordance with the stated prohibitions. The Service User is prohibited from copying, modifying, distributing, selling, or leasing any part of the services or included software, and from reverse engineering or attempting to extract the source code, except where such restrictions are prohibited by law or expressly permitted in writing by the Company. The Company responds to notices about alleged copyright infringement and will terminate accounts of repeat infringers following the process set forth in Thai copyright law.
Liability for Our Services
The Company, its suppliers, and resellers shall have no liability for any lost profits, revenues, or data, financial losses, or for any special, indirect, consequential, incidental, or punitive damages whatsoever caused by reliance on the services, even if the Company has been advised of the possibility of such damages, to the maximum extent permitted by applicable law. The Company's, its suppliers', and resellers' entire liability for any claim under this agreement, including for any implied warranties, is limited to the amount paid by the Service User to the Company for use of the services (or to re-provide the services). In no event shall the Company,
its suppliers and resellers be liable for any damages that were not reasonably foreseeable.
The Company, its suppliers, and resellers shall not be liable for any lost profits, revenues, data, financial losses, or indirect, special, consequential, incidental or punitive damages, however caused and regardless of the theory of liability, including any damages resulting from reliance on the services, even if the Company has been advised of the possibility of such damages, to the maximum extent permitted by applicable law. The Company's, its suppliers', and resellers' entire liability for any claim under this agreement, including any implied warranties, is limited to the amount paid by the Service User to the Company for use of the services (or to re-provide the services). In no event shall the Company, its suppliers and resellers be liable for any damages that were not reasonably foreseeable.
- The Service User must not use the services in any way that is illegal or contrary to public order or good morals, including refraining from the following actions:
- Being a source for spreading computer viruses, computer worms, spyware, and Trojan horses, or being a source used for hacking or attacking other systems.
- Being a source used for phishing to steal others' information.
- Providing services related to software and data that infringe on copyrights.
- Providing peer-to-peer services such as BitTorrent.
- Hosting websites that present illegal or immoral content, or content that is contrary to public order. This includes obscene/pornographic media, content that causes damage to others, gambling, as well as linking to websites of this nature.
- Providing Camfrog services for distributing pornographic media, including any other inappropriate conduct.
- Being a source for distributing images of others where those images have been edited, modified electronically or by other means in a way that defames, insults, causes hatred towards, or embarrasses the depicted person.
- Being a source used for Commercial Mass E-mailing or "Spamming" of any kind. This includes sending advertisements to email addresses without permission, sending to newsgroup users, sending with invalid return addresses for business purposes, sending chain messages to generate responses, and repeatedly sending duplicate messages.
- The Service User must not provide any services involving illegal software of any kind, including trying to circumvent detection by using alternate file extensions. This covers using unlicensed devices, programs or data, and infringing on intellectual property rights.
- Being a source for any activities that violate Thai law or international law, or that cause unrest towards the institutions, nation, religion, monarchy, or general society in any country.
- The company has the right to immediately suspend services temporarily without prior notice to the Service User in the following cases:
- The Service User passes away, or if the Service User is a legal entity it ceases operations, or the Service User has assets seized or attached by court order, or is under receivership.
- An event of force majeure occurs affecting the Company.
- The Service User used forged documents or false information to apply for the service.
- The Service User uses the service illegally, inappropriately, or in violation of this service agreement, regardless of whether the Company has issued a prior warning.
- The Service User exceeds the specified service fee limit, after the Company has notified the Service User in advance that the limit is being approached.
- The Service User fails to pay fees and service charges by the due dates listed on two consecutive invoices.
- The Company proves the Service User has used the service to generate income without intending to pay the fees and service charges.
- The Company needs to maintain or repair the network used to provide the service.
- During a temporary service suspension, the Company has the right to collect fees and service charges under this agreement, unless the cause of the temporary suspension was not due to any fault of the Service User.
- If any fault or problem occurs from using the Server2Day service, the authorized Service User contact must promptly notify the Company, specifying the domain name, service being used, and all relevant details.
- The Service User must keep passwords confidential.
- The Company is not responsible if programs or data on the Service User's server are modified, deleted, leaked, or damaged for any reason. However, the Company will make its best effort to trace, investigate, and pursue those responsible for causing damage to the Service User's programs and data.
- The Company owns all IP addresses it assigns to Service Users, and reserves the right to modify, change, or reclaim IP addresses as it deems appropriate. The Service User cannot claim any damages from such changes.
- The Service User can register up to 2 authorized contact persons with the Company. If there is a change in the authorized contacts, the Service User must notify the Company in writing immediately. The Company will not be liable for any damages if a previously authorized contact requests services on behalf of the Service User before written notification of the change was provided.
- If the Service User needs to back up data to an external device, a request must be submitted at least 3 working days in advance in writing. If there are costs beyond the scope of the basic service, the Company will charge fees as it deems appropriate.
- For changes/additions to personal information like address, phone number, and email, the Service User must notify the Company in writing.
- The Company can inspect the Service User's usage data without prior notice. If abnormal usage is detected, or if the Company deems it necessary, the Company can take action to protect the rights of other users. The Service User cannot claim any damages from the Company for such actions.
- The Company will block IP addresses used for BitTorrent and Camfrog traffic that violates the Computer Crime Act B.E. 2550, such as displaying obscene content, for 24 hours on the first detected violation. The block time will increase by 24 hours each subsequent time a violation is detected from that IP address. This is because in the past when a customer's IP was blocked, they would circumvent by using a new IP to avoid extended blocking for further violations. Therefore, the Company gives notice that each time a customer violates the service terms and conditions, regardless of whether a different IP is used for each violation, the Company will extend the block time by 24 hours for that customer.
- Since phishing can severely impact many internet users, especially internet banking customers whose usernames and passwords are stolen by phishers for malicious use, in cases where the Company detects an IP address being used for phishing, it will notify the customer owning that IP via email and phone. If the customer cannot be reached by phone, the Company will notify via SMS. If after 30 minutes from notification the customer still has not taken corrective action, the Company will block that IP until it is resolved.
- If the Service User defaults on payment for two or more consecutive invoices, and the Company notifies the Service User to make payment within 10 days from the letter date, if that period lapses without payment, in addition to suspending service and terminating the agreement, the Company can remove the Service User's equipment to a common area and not allow the Service User to remove any equipment until all outstanding amounts are paid in full. The Company is not liable for any damages to the equipment during this period. The Company has the right to charge any costs incurred from storing the equipment. If after 2 months from notification the Service User still has not paid, all equipment belonging to the Service User in the Company's possession immediately becomes the Company's property, and the Service User cannot claim any damages.
- Upon termination of this agreement for any reason, the Service User must remove all equipment from the service premises and restore the premises to their original condition within 15 business days from termination. If this period lapses, the Company will remove the Service User's equipment to a common area and not be liable for any damages, and the Service User must pay any incurred costs. However, if more than 2 months pass after service termination without action from the Service User, all equipment belonging to the Service User in the Company's possession immediately becomes Company property and the Service User cannot claim any damages.
- Service Users who have given notice of termination or have been suspended must remove their equipment from the premises only during business hours of 8:30am - 4:30pm Monday-Friday.
- Any letters, notices or communications from the Company sent to the Service User's billing address shall be considered as properly delivered and received by the Service User.
- The Service User must strictly comply with the Company's current and future policies, regulations, terms and conditions related to service provision.
- The Service User must strictly comply with the Company's policies regarding the use of assigned IP addresses.
- The Service User must strictly comply with the Company's policies prohibiting use of the services for unlawful or improper purposes, such as providing services related to software that infringes copyrights or violates laws.
- For services requiring use of an IP address, the Service User understands those IP addresses are provided by the Company, and the Company reserves rights to modify or change those IP addresses.
- The Service User understands and agrees that all equipment and anything sent or provided under this relationship is the property of the Company, and the Service User has no ownership rights over any IP addresses used.
- If the Service User terminates the service after the Company has already prepared to provide the service, the Company will not refund the initial service fee.
- In case of service suspension, if the Service User wants to resume service, they will have to pay a new installation fee at the rate for that particular service.
- If the user violates any condition of this agreement, the company has the right to suspend the service and/or terminate the agreement. In the event of termination, the company will notify the user of the reason for termination no less than 30 days in advance. The user accepts that any action arising from the termination of this agreement does not constitute any violation against the user, and the user remains obligated to pay all outstanding service fees in full.
- For coordinating, notifying updates or changes to account information, or modifying any other components of your service, which includes reporting any usage issues, you must contact from your user account, email account, or any other account that can be verified as being authorized by you. You must contact only via email or ticket support channels. The company reserves the right to reject, not process or respond to any usage issue reports submitted through LINE program, LINE@, or any other channels where the company cannot keep service records and cannot verify and confirm the identity of the reporter.
- Server Today (Thailand) Co., Ltd. places great importance on protecting your personal data. This privacy policy describes the practices regarding the collection, use, or disclosure of personal information, including the rights of personal data owners under personal data protection laws. This covers the Personal Data Protection Act B.E. 2562 (PDPA), the European Union's General Data Protection Regulation (GDPR), and the California Consumer Privacy Act (CCPA) of the United States.
- The company reserves the right to change, modify, or add to this agreement as deemed appropriate.
- The company reserves the right not to be responsible in any case where the user's data is lost, even though the company performs daily data backups. Therefore, users should always maintain at least one backup copy of their data.
- In cases where the user does not pay for the service within the specified period, the company reserves the right to suspend service to that user.
- Refrain from using the provided email service in a way that causes inconvenience to others, such as posting impolite messages, advertising, disseminating information or news that causes annoyance to others or creates misunderstanding in public information sources like website message boards.
- Users who send emails categorized as SPAM will be held responsible to the company and consent to compensating for any damages incurred.
- Users are prohibited from performing any actions that may cause deterioration or damage to the overall server system.
- Refrain from using this service to store or disseminate data, images, audio, or messages that insinuate fraud, obscenity, illegality, and immorality, including pirated software, cracks, hacks, or using this server's service to attack other servers such as mail bombs, hack attacks, spamming, port scanning, or port probing. Users who disseminate this type of data or use the service in this manner will be considered in violation and will be prosecuted to the maximum extent of the laws of the Kingdom of Thailand.
- The company has the right to refuse service requests without having to explain the reasons, and reserves the right to cancel the membership of those who violate or attempt to violate the agreements and service regulations without prior notice.
- Users are prohibited from using this service to store and disseminate any data that replicates, modifies, or infringes on copyrights, or using this service to store data or provide any service to other websites.
- The company is not responsible for performance, delays, errors, data loss, or any damages beyond the company's control.
- The company reserves the right to take immediate action (such as changing passwords, closing email accounts) without prior notice when any actions that may compromise the user's account security system or access data that poses security risks are detected.
- The company reserves the right to immediately cancel this service if it is found that the user has violated the agreement, or if such actions may cause or pose a danger to the overall server, such as violating the security system, attempting to infiltrate the system, or attempting to access server data and other members' data, or performing any actions that place a heavy burden on the server.
- The company reserves the right to use and/or disclose member information when requested by government officials.
- In cases where the company receives complaints, requests, or encounters improper causes, the company reserves the right to cancel or temporarily suspend service to those users in order to investigate and determine the causes of such incidents.
- In cases where the user does not pay for the service within the specified period, the company reserves the right to suspend service to that member.
- The company reserves the right to change the terms of this service agreement at any time without prior notice.
